New scheme could rein in private clampers

A new Government licensing scheme could give motorists more protection from private clampers, The Telegraph reports.

The scheme, the outline of which is expected to be announced later today, will place limits on the maximum release fees that can be charged and the minimum time set before a car can be towed. It will also demand that signs that warn drivers that private enforcement companies are working in the area are clearly visible.

Motorists will also be given the right of appeal against private clamping charges, the paper says, with plans being mooted for the setting up of an independent tribunal.

The scheme follows a public consultation by the Home Office on how to eliminate sharp practice in the wheel-clamping business.

Enforcement companies are currently able to issue private parking tickets, gaining access to car-owner's details through the Driver and Vehicle Licensing Agency (DVLA)'s records. The new system would see access to the agency's database limited to members of approved trade association, the British Parking Association (BPA).

However, last week the AA said that the BPA "cannot be truly independent and provide proper protection for the general public".

"How on earth can people believe that if you appeal to an enforcer you are going to get a fair hearing," asked AA spokesperson Paul Watters. "The BPA will not act as arbiter."
